Man in crosswalk seriously injured in pedestrian accident

In Southern California, there is overwhelming concern over the frequency with which pedestrians are injured and killed in an auto accident. Given the vulnerability of a pedestrian, the chance of there being severe injuries and fatalities in pedestrian accidents is significant. With this in mind, it is imperative that those who have been hurt or lost a loved one in a pedestrian accident understand how to accrue evidence so they can pursue compensation in a legal filing.

An evening accident between two cars led to a pedestrian being hit. The man, 56, was taken to the hospital in critical condition after one of the vehicles involved in the crash hit him. He was walking in the crosswalk at approximately 6:30 p.m. when the accident occurred. A Mercedes and BMW were the vehicles in the accident, but it is not known which one struck the pedestrian. The driver of the BMW, a 34-year-old man was placed under arrest for felony DUI.

Pedestrians are in a constant state of vulnerability. This is true even if they are obeying all the necessary traffic laws that apply to them and are vigilant regarding their surroundings. There is no way to know when a reckless or negligent driver or a motorist who is under the influence of drugs or alcohol will come upon them. Drivers who violate the law or are behaving irresponsibly can cause an untold amount of damage to a pedestrian. If the pedestrian survives the accident, there could be massive medical expenses, the need for surgery, rehabilitation and the possibility that care will be needed all day, every day for the rest of his or her life. It can be an emotional, financial and personal strain on any family. With a fatality, the family will be deprived of a loved one.

With a pedestrian accident, the circumstances are often key when considering a legal filing. In this incident, the man who was hit was apparently in the crosswalk when two cars collided and the pedestrian was hit. With one of the drivers arrested for DUI, there is the foundation for a legal filing. Of course, it is imperative that he and his family have legal help to gather evidence regarding this incident.
